Officers arrived on scene and could see Cooney through a window with another male later identified as John Via. As officers entered the home to apprehend Cooney, he and Via attempted to run upstairs to conealthemselves. Officers ordered to Cooney to stop and was taken into custody.
Upon searching Cooney, officers discovered that Cooney was in possession of several articles of drug paraphernalia.
Officers questioned the homeowner, Jill Kostowskie, about the other male that was with Cooney. She indicated she did not know who he was and allowed officers to search the home for him.
In a second floor bedroom officers located Via hiding underneath a bed. Officers ordered Via out from underneath the bed and in the process observed a hypodermic needle lying on the floor near Via’s hip. Officers questioned Via about his identity to which he provided false information. When Via’s identity was confirmed, he stated he provided the false information because he thought he had warrants.
